Terms and Conditions
Last updated and effective: September 30, 2026
Eekaam SMC (Pvt) Ltd, Karachi, Pakistan (trading as Eekaam)
1. Who we are and what this is
These Terms and Conditions ("Terms") are a contract between you and Eekaam SMC (Pvt) Ltd, a company registered in Pakistan with its principal place of business in Karachi, Pakistan, trading as "Eekaam" ("Eekaam", "we", "us"). They govern your use of the Eekaam e-commerce platform: the website at eekaam.com, the merchant dashboard, the mobile app, our APIs, storefront hosting and every related service (the "Platform").
You accept these Terms by ticking the acceptance box when you create an account, or by clicking "Accept" when we present an updated version. We record the date, the version you accepted and the IP address it was accepted from. If you do not agree, do not use the Platform.
2. Definitions
- "Merchant" — a person or business that registers on Eekaam to operate an online store.
- "Customer" — an end user who visits or buys from a Merchant's store.
- "Store" — the online storefront a Merchant creates and manages through Eekaam.
- "Services" — everything the Platform provides, including store hosting, themes, the theme editor, order and inventory management, analytics, marketing tools, integrations and AI features.
- "Plan" — a paid subscription tier described on our pricing page.
3. Your account
You must be at least 18 years old and able to enter a binding contract. You must give accurate information and keep it current. You are responsible for everything done under your account and for keeping your credentials confidential; we recommend enabling two-factor authentication. Tell us at support@eekaam.com immediately if you suspect unauthorised use.
4. The Platform
Eekaam provides a multi-tenant e-commerce platform on which Merchants create Stores, manage products, take orders and connect payment providers. We may change, add or withdraw features with reasonable notice. We aim for continuous availability but do not promise it; planned maintenance is announced in advance where practical.
5. Free trial, plans, billing and automatic renewal
- Free trial. New accounts get a 14-day free trial. No payment method is required and nothing is charged during the trial. When the trial ends you choose a Plan; if you do not, your Store is suspended until you do. We never charge you without you selecting a Plan and entering a payment method.
- Automatic renewal. Plans are subscriptions. They renew automatically at the end of each billing period (monthly or yearly, as you selected) and your payment method is charged the then-current price of your Plan until you cancel. By choosing a Plan you authorise these recurring charges.
- Cancelling. You can cancel at any time from Settings → Billing in your dashboard, in as many steps as it took to subscribe. Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again.
- Reminders. We email you a receipt after every charge, and a reminder at least 7 days before a yearly Plan renews.
- Price changes. We give at least 30 days' notice by email before a price change takes effect on your Plan. If you do not want to pay the new price, cancel before it takes effect.
- Payment processing. Subscription payments are processed by Lemon Squeezy, LLC, which acts as merchant of record for subscription sales and handles applicable sales taxes and VAT. We do not store card numbers.
- Failed payments. If a renewal payment fails we retry and email you. If it still fails after 7 days your Store is suspended until payment succeeds.
- Refunds are governed by our Refund Policy.
6. Merchant responsibilities
As a Merchant you agree to:
- Comply with all laws that apply to you and your Store, including consumer-protection, tax, advertising, and data-protection laws in every market you sell to.
- Sell only goods and services you are legally allowed to sell, and not sell counterfeit, stolen or prohibited items.
- Provide accurate product descriptions, prices, shipping terms and policies, and honour them.
- Publish a privacy policy, refund policy and terms of service for your Store, and keep them accurate (Eekaam provides editable starting points, but they are your documents).
- Obtain any consent the law requires from your Customers before using cookies, pixels, marketing email or SMS, and honour opt-outs. The Platform provides consent and unsubscribe tools; using them correctly is your responsibility.
- Handle customer service, returns and disputes for your Store promptly.
- Hold the licences, registrations and tax numbers your business needs.
7. Prohibited use
You may not use the Platform to:
- Sell illegal, harmful or regulated products without the required authorisation, or products that infringe someone else's rights.
- Commit fraud, launder money, or deceive Customers, including with fake reviews, fake scarcity or misleading reference prices.
- Send unsolicited marketing, or upload contact lists whose owners have not consented to hear from you.
- Distribute malware, attack or overload the Platform, or access other Merchants' data.
- Scrape or harvest data from the Platform or other Stores without permission.
- Resell or sublicense the Platform, or use it to build a competing service.
We may remove content or suspend a Store that breaches this section, with notice where the law allows.
8. Intellectual property
The Platform, its code, design, documentation and branding belong to Eekaam and its licensors. You keep ownership of your Store content: product data, images, text and your brand. You grant Eekaam a non-exclusive, worldwide licence to host, copy, display and transmit that content as needed to run the Services, and to make backups. Themes and apps from the Eekaam marketplace are licensed to you under their own terms.
9. Data protection
Our Privacy Policy explains how we handle personal data about you. For your Customers' personal data, you are the controller and Eekaam is your processor; our Data Processing Addendum forms part of these Terms and sets out our obligations, including the sub-processors we use and breach notification within 72 hours of confirming a breach that affects your data.
AI features. When you connect an AI assistant (for example Claude or ChatGPT through our MCP connector) or install an AI-powered app, the data that assistant reads — which can include your Customers' names, contact details and orders, within the scopes you approve — is sent to that AI provider under its own terms. You decide whether to connect it, and you can revoke access at any time from Settings → AI apps. Eekaam does not use your Store data to train AI models.
10. Third-party services
Payment gateways, shipping carriers, advertising platforms, apps and AI providers you connect to your Store are separate services under their own terms and privacy policies. Eekaam is not responsible for them. Some integrations (for example advertising pixels) place cookies or scripts on your Store; it is your responsibility to enable them only where you have the consent the law requires.
11. Warranties and liability
The Platform is provided "as is" and "as available". To the extent the law allows, we exclude all implied warranties, and we are not liable for indirect, incidental, special, consequential or punitive loss, or loss of profit, revenue, data or goodwill. Our total liability to you for all claims in any 12-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability that cannot be limited by law.
12. Suspension, termination and your data
- You can close your account and delete your Store at any time from Settings → General (Danger zone).
- We may suspend or terminate your account for non-payment, a breach of these Terms, unlawful activity, or a risk to other users or the Platform, giving notice where practical.
- After cancellation or termination your Store goes offline. Your data stays exportable for 30 days, after which it is permanently deleted from our live systems (backups roll off within a further 30 days), except where we must keep records by law, such as invoices.
13. Governing law and disputes
These Terms are governed by the laws of Pakistan. The courts of Karachi, Pakistan have exclusive jurisdiction, except that you may rely on mandatory consumer-protection rights of the country you live in where the law gives you those rights.
14. Changes to these Terms
When we change these Terms materially we will publish the new version with a new effective date, email you at least 14 days before it takes effect, and ask you to accept it the next time you sign in. Your acceptance record is updated with the new version. Minor changes (typos, clarifications) take effect on posting.
